To the Users (as defined below), we inform you that the following Privacy Notice is applicable to you by simply using or accessing any of the pages, web and mobile applications, software, and applications in general that make up the Portal of www.metalcraftlaguna.com (hereinafter collectively and indistinctly referred to as the «Portal»). By accessing the Portal, we will understand that you accept and agree to comply with it. If you do not agree with the Privacy Notice and/or the Terms and Conditions available to you, you must refrain from accessing or using the Portal.

 

The User, understood as the person who uses or accesses the Portal via a computer and/or any communication device or equipment (hereinafter the “User”), fully and unconditionally accepts all the provisions included in this Privacy Notice.

 

RESPONSIBLE PARTY FOR THE PROCESSING OF YOUR PERSONAL DATA 

For METALCRAFT LAGUNA, S.A. DE C.V. (hereinafter the «Company»), the security of Users is our priority, and we protect your personal data by implementing, applying, and maintaining high technical, physical, and administrative security measures. 

As a User, you have the opportunity to choose from a wide range of products and services through our Portal, knowing that your personal data will be protected and treated confidentially. We inform you that the RESPONSIBLE PARTY for collecting, processing, and/or using the personal data that the User provides through the Portal is the Company, along with its subsidiaries, affiliates, parent companies, and associated entities.

The personal data that the Company may collect from the User when using the Portal and/or contracting our products and services are as follows: 

  1. Name, phone number, and email address.

 

PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA 

The personal data collected by the Company will be used to serve the following purposes: 

  1. To contact our customers and/or those interested in our services to resolve their questions and meet their needs. To generate advertising and promotions for our services through various digital media, all of which are exclusive to the company.
  2. To create files, databases, and systems necessary to carry out the corresponding operations and services; (ii) To claim the delivery of prizes and/or promotions; (iii) To carry out internal analysis;

Additionally, your personal data may be used for the following secondary purposes: (i) Marketing, advertising, and commercial prospecting; (ii) To offer you, if applicable, other products and services from the Company or any of its affiliates, subsidiaries, parent companies, associated companies, agents, or entities; (iii) To send you promotions for other goods, services, and/or products; (iv) To conduct statistical analysis, information model generation, and/or current and predictive behavior profiling; and (v) To participate in surveys, raffles, and promotions.

 

OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF YOUR DATA 

The Company has implemented administrative, technical, and physical security measures to protect your personal data, which we also require our service providers to comply with. You can limit the use or disclosure of your personal data by sending an email to info@inmar-bienesraices.com, indicating in the body of the email your full name and the data you wish not to be disclosed. If your request proceeds, you will be registered in the exclusion list.

 

MEANS TO EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION, OR OBJECTION (ARCO RIGHTS) 

You may send an email to info@inmar-bienesraices.com at any time to exercise your Access, Rectification, Cancellation, or Objection Rights (“ARCO Rights”). To exercise the ARCO Rights, you (or your legal representative) must submit the request and identify yourself with the following documentation: 

  1. Name of the user or holder.
  2. Address of the user or holder or another means to communicate the response to the request.

III. Documents proving your identity (IFE/INE or passport) and, if applicable, the documents proving the legal representation of the applicant. 

  1. A description of the information/data you are attempting to exercise your ARCO rights on and the rights you wish to exercise.

 

If one or more of the documents mentioned above are not included, and/or the documents contain errors or omissions, the Company will notify you within 3 business days following the receipt of the request and will ask for the missing documents and/or necessary corrections. You will have 5 business days from that notification to provide the updated information, otherwise, the request will be understood as not submitted.

 

TRANSFER OF PERSONAL DATA 

The Company may disclose your personal data to third parties who, due to the services and products offered, need to know them to properly fulfill the same. 

Furthermore, the Company may disclose your information to the competent authorities in accordance with applicable legislation; any transfer of your personal data without consent will be carried out in accordance with Article 37 of the LFPDPPP.

 

WEB BEACONS 

The Company may or may not use tracking technologies such as web beacons, similar to cookies, to gather data on your visits to the Portal. These are small electronic images embedded in web content or email messages, which are usually invisible to Users and allow us to generate almost personalized content to offer you a better experience when using our Portal. 

If you do not agree with any of the conditions set forth here, the User may always change the settings of their browser.

 

MODIFICATIONS TO THE PRIVACY NOTICE 

This Privacy Notice may undergo modifications, changes, or updates due to, among other things, new legal requirements; internal needs of the Company; the products or services we offer; our privacy practices; changes in our business model, or other causes. 

 

Any modification to this Privacy Notice will be notified through any of the following means: a written notice sent to your address; by the email address you provide; a message to your mobile phone; a message made available through the Portal or any electronic medium you use to carry out operations; or in newspapers of wide circulation at the Company’s corporate address.
